It was never officially available (whether direct download or transfer from DSi), but like every DSiware it can be unofficially installed

You can get Flipnote Studio 3D if you go to my.nintendo.com and make an account (assuming you don't already have one). After you have enough points go onto the redeem section and there should be a option to get Flipnote. This will give you a download code redeemable on the Nintendo 3DS eShop.
