I sincerely apologize for starting another poll, but the main thread on the recent banwave is moving entirely too fast and people are way too concerned with arguing over things completely unrelated to the subject at hand. And again, I'm trying to narrow down exactly what sparked this. The bans seem entirely too sporadic to just be a blanket ban on everyone using homebrew and SpotPass as not everyone in this criteria have been banned (yet). Anyway, I was thinking that it's a high possibility that the bans may be related to Doodlebomb users, whether they be senders and/or receivers, since it obviously relies on Nintendo's online services. Again, I apologize for opening another poll amongst the hundreds of others, but as a community I feel we should work to pinpoint this instead of relying on conjecture and assumptions. This could also explain why vanilla consoles have also been banned as they could have received the exploited message but never carried through with the rest of the homebrew process.

Also, if this scenario has already been concluded then feel free to report this thread to have it closed.

Edit: It may have also affected those that installed it offline.

So the "No's" have been consistent in this poll, meaning this may not be the cause, though I'd still like to wait and see for more answers.

I am not banned. I had not sent or received any doodlebombs tho I did get it set up and used the doodlebomb feature for my own 3ds
Senders and receivers would be pertinent to figuring this out as it uses Nintendo's servers to do this. Doing it totally offline most likely wouldn't trigger the ban, but thanks for the input. It's important nonetheless as we can use that information to narrow it down even further.

Haven't touched Doodlebomb, and my n3ds has spotpass and titlesharing on. I opened the homebrew channel and some homebrew CIA's today repeatedly while online, when Daddy Nintendo sends the next wave I'll let you know if I've been hit via PM. If I had my o3ds on me, I'd do some adventurous testing on it (ie. online cheats while on a game of a non-matching region) but it's currently loaned out to a friend. Also, a few details that could be useful:
Firmware: US11.4 n3Ds
Current Haxtype: old a9lh (not system installed, entirely SD dependent)
Most recent usage: Near constant the past few weeks, playing the Japanese copy of FE:EchoesSoV (Part of the time with online on, part with online off)
Friend Title Sharing: On
Spotpass: On
Prior used methods of Hacks: Menuhax->RXTools3.0, Menuhax->Reinand3.x, Menuhax->Reinand4.x

Meanwhile, I'll be playing smash since I went through the trouble of opening it to test if I was banned, let me know if you want me to try anything though

Perhaps the DS's have to connect to the internet during the time-period of the wave's active time, and it looks for signs of modification? So, hypothetically, if you could avoid the times Nintendo sends out the waves, you could avoid the bans. Again, just a guess.

Coincidentally, I've wondered this myself. Since this started I've indefinitely kept my WiFi disabled only to check if I was banned. I turn it on for a few seconds, open the Friend List, and then disable it again. That said I've still not been banned.

You're also another European user, though. It may not be as widespread in Europe yet as there are numerous regions there as opposed to North America and Japan. This also makes me wonder how many Australian and New Zealander users have been banned since they use EU consoles.

Alright, so now the "No, I haven't used it and am not banned" answers are becoming the majority. I'd like to see some more answers before drawing a conclusion, but this may be the most logical one we have.
