LOL the majority had it enabled but aren't banned. Yep, seems like this is the cause.

Can you count? Majority is more than 50%.

Also, among the people who were banned, overwhelming majority had spotpass enabled. Furthermore, the people who had spotpass enabled but haven't been banned aren't out of the woods. They just haven't been banned yet.

I think this is a cause (I mean from the data it's pretty clear) but possibly not the only one, maybe the other cause would be having shared the currently played title in the friends list.

I still find very weird that the cause of the bans is this.
I almost never went online (and the times I went online I didn't cheat)
I disabled both options the day I got my N3DSXL (even on SNES VC)
97% of the time my N3DSXL was on airplane mode (1% for freeshop, another 1% for SD Card management and the last 1% for local multiplayer)
And I still got banned

Im using my console online And i don't have ban but snice day one (2 years ago) i have every tracking option OFF like eshop suggestions And spotpass console data sender, but recently i hide my conection status And muy currently played game

do you mean having a "hacked" application like freeshop or cia installed games as favorite title?

I had to turn WiFi back on just to answer the poll.
I have it enabled and was NOT banned.
Now WiFi is back off.

Actually majority is just the greater number, of the 4 categories that one had the most votes. This wasn't a binary choice.

Also, we don't know what the cause of the ban is, could this be the way Nintendo finds out? There is a very strong possibility. It's a stretch to say this is the cause of the ban LOL, especially when we don't know any other details such as CFW, titles installed, type of online use, etc...

There is a correlation between vehicle accidents and black colored cars, do you believe the cause of those accidents is the car color? LOL

I actually had the spotpass setting enabled AND had Freeshop set as my favorite title on the friends list and I'm not banned as of now.

I haven't played online recently (a few months?) but I did update my console to boot9strap the other day (which involved the console going online for the friends list)

No, majority is over 50%. The word you are looking for is plurality.

We never said it was the cause of the ban, but it is probably a cause of the ban. You can quibble about other variables all you wish, but there is a strong correlation here.

Correlation certainly doesn't prove causation on its own, but it does suggest it. For the black cars/collisions thing, if the correlation is strong, then it could suggest that there is a contributing element (such as making black cars harder to see at night), or it could be a proxy variable for some other factor or set of factors (who buys black cars, what their driving habits are, etc).

I have a theory What if there are 2 classes of spotpass information? I mean the console information spotpass And the game information spotpass soo im not banned but if i cheat a specific game like mk7 with mk7 spotpass setting active soo.. it Will be a ban only for this game right?

can we unban with friend code swap, like pokemon sun/moon ban wave?

Friend code seed, and yes. However, until the causes are better established, it is unwise to burn the seeds. They have to come from an unbanned console. We can't sign them without Nintendo's private keys.

You don't base an assumption off of just 1 metric, there should be more information as to what the people did, especially with such a small sample size....

Believe what you want, but I think you have a very misguided view of statistics.
