Hacking Hacked 3DS but no kernel exploit? Help

Okay my friend purchased a hacked 3DS. We put a freshly formatted SD card into it, the buyer formatted prior to shipping. it says Sys in the settings, we put the files on the root of the SD, including CIA files we want to install, we can boot godmode. When we try to inject H&S it fails, and when we try to launch FBI in HBL it fails saying no kernel exploit which is probably why its failing on H&S inject too....

So with no kernel access, I was given the opt bin file, and the original 11.3 backup, what should I do step by step to correct this so I can be granted kernel access

edit: we can get into godmode and luma config, I have luma arm9loaderhax.bin on the ctr nand, and configured it without the SD card in the device and saved to the device.

can get in luma config on SD and without SD.

Did you put arm9loaderhax.bin on it, also follow this from scratch https://3ds.guide.com

just edited the post, arm9loaderhax.bin is in and configured under 1: ctr nand

Then what is the exact problem? More info on the device would be nice, also your Luma config

there are no CIAS on the device so I can't update anything, this is all strictly from the 3ds guide, copied verbatim getting the FBI, Luma updater, HBL cias putting into a folder, getting thee arm9loaderhax.bin putting on ctr sysnand and configured with the correct settings, both luma with and without SD card is configured, but i have no kernel access............. so i cant launch FBI in HBL or in H&S inject

I don't understand why you don't have kernel access? You can do it manually.

Without SD, launching luma, only thing checked is show NAND or user string in system settings

Set developer info and exception handlers.

With SD in, luma config only thing is autoboot sysnand, use sysnand firm if booting with r, and show nand or user string blah blah, and this is with the SD in.........

If you can access gm9 from boot you must somehow have kernel access.

What's the exact error message you get when trying to inject FBI into Health & Safety?

Did the device ever be downgraded with a GW? Because the HS.app may be fragmented.
