Hi Guys, Today i read a thread that said we can be banned for using freeshop/Tikshop games.

I think its safe play games from tikshop/freeshop and i think it's impossible nintendo would ban for using tickets because if they do that, they would ban also retail consoles with preinstaled games. Nintendo cannot difference between cias-legit cias (preinstalled)-downloaded cias fron CDN (nintendo server)
Also, tickets are not assigned to any NNID so nintendo doesn't know neither if you bouthgt a game or if you downloaded it.

If anyone have feedback about this, i will apretiate your opinion.

You are not going to get banned for using freeShop games nor CIAs. At this point in the game, it's not worth Nintendo's time to even bother banning people over freeShop/CIA games. There's really only 3 major reasons someone can get banned.
1: Playing a super popular game early, like Pokemon. Monster Hunter fans didn't get banned for playing online early
2: Cheating online.
3: Using non-private header with a flashcart (doesn't effect CIA/freeShop.)

What you said makes sence, because lots of people be banned for playing these games before release date. We need to make sure the game is already released.
Cheating online i dont know but if you said you have knowledge.
I have sky3ds+ and i have private header.

I am realy afraid to be banned for playing freeshop/tikshop or downloaded cias games from internet.

I have 2 consoles, 1 with cfw and another one without it. Do you recomend me to do a system transfer and transfer my NNID, legit games, pokebank from my cfw console to my non cfw console?
So i can have one console for cias and have another console with legit content and also can use sky3ds+ with private header on that.

What do you think Glaceon?

they could start banning everyone using freeshop installed games tomorrow for all I know, but so far they dont ban unless you are cheating .

He mean tomorrow because they can do it at any moment.
Nintendo know which title you are using while using internet.

It sent data (TID) to the server so the friend list reflect what you are currently playing.
So yeah, they know users are using homebrew, freeshop, maybe they have an entire list of them, maybe they could ban them tomorrow...
Every possibilty are between Nintendo hands.

from what i know there's no way to differentiate a pirated game and a legitimate copy through nintendos eyes.You're safe as-long as you aren't cheating or playing leaked games

Like @VinsCool mentined, there's no such thing as illegitimate games. The games that you install are literally the same as any legitimate game from Eshop. Basically the game is always the game regardless, it's completely 1:1. The only difference is that users are basically bypassing the paywall and installing the game without paying up for it. But in the end it's the same game, same properties. This is why it's not possible for Nintendo to detect if you bought a title or not. Once installed to the system, the system plays it just fine. And CFW such as Luma3DS has patches to disable signature checks so anything you install will play. By default, the system can't play any titles that don't have a legit ticket, and CFW bypasses that. Nintendo doesn't do checks for tickets. Once you start the game up and play it, it's the same as any other game. The system is the only thing that does legitimacy checking, and you bypass it with CFW.

In short, you won't be detected or banned unless you do any of the things Crystal The Glaceon mentioned.

A leaked game is a game that becomes public and playable before release date. If you install one of these and go online with it, nintendo will ban you if they are watching. Only major incident I've heard of so far is with pokemon sun/moon.

There is nothing to worry about. Basically, if u don't do dumb shit, there's no reason to fear a ban.

The way the games are registered to the system would make it extremely hard for Nintendo to figure out which one is legit or not. Basically they would run a massive risk of banning people with legit games in the process.
Nintendo just can't randomly ban people, unless they can prove without a doubt that the game isn't legit. This is basically a flaw in the eShop and how the system signs games.

For example, you download the Pokemon Moon(Popular game) game somewhere, and the official release day was November 18, 2016. So if you go online with the game BEFORE the release day, Nintendo can easily find you and ban you because nobody should be able to play the game at that time so if you're playing that means you're mostly using leaked game.

Thats what people are assuming, but how can we know for sure? Also even if the games look legit, freeshop itself must be detectable.
Pretty sure if there was a clear difference between the legit eshop ticket and freeshop ones they'd start banning people left and right. I think eshops system is flawed and they'll have a hard time comparing if the ticket is owned by the users nnid.

Thats based on assumptions, and you still have to actually run freeshop on your system. freeshop itself must be detectable, nintendo just hasnt gone ban happy. Its the same situation with the ps3, sony just seemingly randomly bans some people though.

Ofcourse it is, that's all we can do for now. However i think they'd have done something by now if it was easy.

I think Glaceon is right. He said 3 only major things about ban.

- Play laked games, play them early.
- Cheeting during online play
- Using public headers insted of private headers in flashcards like sky3ds+.

If we do not do this, we are in safe side.
