Hacking Will Mario kart require an update ??

So I'm sure no one knows the answer yet but Is it's possible for Nintendo to make Mario kart only run if you're on the newest firmware. I'm gonna be buying it off the Eshop and I'm very paranoid of this happening.

( and before someone mentions how homebrew isn't gonna happen for a long time. I don't care how long it's gonna take as long as I get the chance of homebrew when it comes out.)

Mario Kart 8 deluxe possess a 2.0 update file ...

I guess what the user really wants to know is rather the switch will ask to update him to 2.0 with the mario kart 8 cart if he's still on 1.0 stock ... this could be a key to get on 2.0 (if you are on 1.0)
