Hacking the console is againt term of use, which can be count as unlegit.
The worst thing that can happen is my warranty is voided (you know, the warranty thats only good for one year) and not having access to online services.

I still consider my handheld legitimate by my standards. It can still connect online and I can still make purchases on the eShop (which I do)

yeah, I just learned that you completely missed the point.
Mind filling me in what the "point" is? I'm listening.

Some people just don't care about the console being hacked or not and they just wanna do things by the line, by the ''rules'' if you have it say it that way.

Also, no need to get defensive, I have a hacked 3DS and I still legitimately buy my games.

You have a funny definition of defensive.

Anyways, I can respect someone not having any interested in a modded console but there is no line between legitimate or unlegitimate. What would make my 3DS with arm9loader + luma3DS any more or less legitimate than a factory sealed unit at a retail store?

That's your point of view.
The truth is when you bought the console, you got the right to use it as Nintendo intend to.
Not the right to modify the sotfware.

  1. Software License
You may use the software, content, and data that came with your Nintendo 3DS or that is compatible with and authorized for use on your Nintendo 3DS, including any updates or replacement to that software, content, or data that we or our authorized providers make available to you (collectively, the "Software") subject to the terms of this EULA. The Software is licensed, not sold, to you solely for your personal, noncommercial use on your Nintendo 3DS. You may not publish, copy, modify, reverse engineer, lease, rent, decompile, or disassemble any portion of the Software, or bypass, modify, defeat, tamper with, or circumvent any of the functions or protections of your Nintendo 3DS, unless otherwise permitted by law. The Nintendo 3DS handheld video game system and accessories, the Software, and any services available using the Nintendo 3DS (collectively, the "Nintendo 3DS System"), are constantly evolving, and we may update or change your Nintendo 3DS System, in whole or in part, without notice to you. Such updates or changes may be required for you to play new Nintendo 3DS games, enjoy new features, or continue to access Nintendo 3DS services. After your Nintendo 3DS System is updated or changed, any existing or future unauthorized modification of the hardware or software of your Nintendo 3DS System, or the use of an unauthorized device in connection with your Nintendo 3DS System, will render the system permanently unplayable. Content obtained through the unauthorized modification of the hardware or software of your Nintendo 3DS System will be removed. You agree not to use your Nintendo 3DS System in an unlawful manner or to access the systems, devices, accounts, or data of others (including Nintendo) without their (or our) consent.
Yeah. You can do what you want since Nintendo won't do anything about it if it won't effect their sell.
Just telling you that hacking console is not legit, even you bought the games on it afterward.

For Hardware part, yeah. You can do what you want since Nintendo won't do anything about it if it won't effect their sell.

Nothing in that documentation says my console is any less legitimate than anyone elses 3DS. I fail to see the fine line, sorry.

Its not legit nor it has ever been legit. Sony does it worse, they ban any PS3 console that logs in with CFW, bought games or not you're still performing unauthorized modifications to your console.

Click on Nintendo 3DS/Nintendo 3DS XL > End User License Agreement (EULA)
It will take you to the same document where I got the infomation putting in the quote.
Buying the games normally, don't pirate, yes, that's legit.
Modify Nintendo Software (Installing A9LH + CFW) = That's not legit.
It said in Nintendo 3DS End User License Agreement in the line I put an underline on.

Your talking about a completely different company in which I have no experience with. Lets not get off topic here.

Having more access to your system whether its by unofficial means or not doesnt make it any more or less legitimate. If it was some knockoff version of a 3DS from China that can only play tetris and snake than yeah I can acknowledge THAT 3DS is not legitimate.

Alright, I read it and I still dont see anything saying a modified unit is illegitimate. I'm trying my best to find that detail.

Well then, try taking that ''legit'' 3DS to Nintendo and ask them to repair it if one day does it decide to break.
Mention the fact that you have CFW and AL9H and see where it gets you.

Nintendo has been attempting to prevent unauthorized modifications update after update, making it impossible at the time to install AL9H and CFW on 11.3
Now, if such a thing is legit, they wouldn't try to stop people from doing it would they?

Doesn't install A9LH + Luma3DS (= modify/bypass/tamper portion of the Software, in this case is 3DS FIRM) count as "modified unit"?

Its funny you mention that detail after I just said this. Proves you arent reading what I post.

I own dozens of gaming systems and I take care of them. On the chance it needs repairing I'd feel more comfortable doing the repairs myself or someone else before Nintendo, I've actually sent in a "legitimate" unit to them and they didnt do shit with it, not even updated it when that unit was outdated at the time.

Thats terrific and I'm glad you can acknowledge this in the ToS but nothing in there says my system or anyone elses that modified it is illegitimate, sorry.

I am actually, the thing is, you're having a hard time understanding what legit means.
If you're buying your games with a hacked console, to you your console is legit, in the eyes of Nintendo itself, it is not.

Up to you then, it already state that modify/bypass/tamper portion of the Software of 3DS is wrong, which call "illegitimate action".
But you still stand on your opinion that "modified 3DS Software isn't illegitimate". So I don't know what to say at this point

PS. Please, could you explain why "modified 3DS Software isn't illegitimate" while it state in ToS that "You may not publish, copy, modify, reverse engineer, lease, rent, decompile, or disassemble any portion of the Software, or bypass, modify, defeat, tamper with, or circumvent any of the functions or protections of your Nintendo 3DS, unless otherwise permitted by law.". May be I understand more about what your thinking.

I think he's taking it that its a ''bad'' thing, which is not.
Even borrowing one of your friends 3DS cartridge is considered a ''non-legit'' action because you're borrowing a game which you did not paid for, it doesn't make it wrong tho nor illegal for that matter.

why would someone even want to remove a9lh in the first place? btw it's already possible to boot a 3ds with a9lh without an sd card inside
Not everyone is interesting in hacking their system and realize that it's something they shouldn't be missing with if they don't know what they are doing. Just because we want to hack our systems, doesn't mean everyone else does.

Also lol, EULA are so cute.

I'm ready to agree with you just as soon as I see the documentation stating that modified systems are illegitimate. I'll wait however long it takes.

You are arguing for the system isnt legitimate if modified. Its on you to prove that statement is true. Otherwise its just an opinion that modified systems arent legitimate and that means squat to Nintendo or anyone.

Why even it state in ToS that "You may not publish, copy, modify, reverse engineer, lease, rent, decompile, or disassemble any portion of the Software, or bypass, modify, defeat, tamper with, or circumvent any of the functions or protections of your Nintendo 3DS, unless otherwise permitted by law." still not prove that "modified 3DS Software is illegitimate" is true then? That what I want to know. I stop arguing since look like I can't change your mind though.
