Not to be rude, but those are conflicting emails. Some look completely different than others, some say that the length of the ban is unknown, some say that it's permament, and there was even one that claimed it was 15 days iirc. Only NoJ actually knows the length, so speculating here won't bring us anything.

The online play ban has a known bypass method, it's the 2812/eShop ban that's annoying most people.

Online play would be enough of a bypass. Screw the eshop. I'll either download games or buy carts.

I am pretty sure you can use all versions as long as you do not have a EUR 3ds.

The "leaked version of 0" is the cart dump. Any cart that is dumped will have a version of 0.
This part I can get behind. I'm sure they can tell if it's a cart or a.cia based on header info.

Nintendo also banned people for playing early before release date, retail cart or not. - Right so how does the version number have anything to do with anything. I think Nintendo just banned everyone..or mostly everyone who got on their servers early.

Yes, exactly, the cart dump had a version of 0. And you installed a cart dump via CIA. Guess what ? Wrong version, because the CIA needed version 16/32
As I told you, they could ban you for a number of things. Many people had already reported that Nintendo told them there were 2 types of ban - 1 for playing early and 1 for pirating. Guess how they know you were pirating ? Yes, they probably checked your version or simply because you were playing as CIA before release.
