Yeah, though the chances of a rich lawyer's son getting the game early is probably pretty slim. Not a ton of them leak early and of those that do, there's not a huge chance the person buying is rich or a lawyer. Most are Nintendo enthusiasts like us who just want to play early.

Ok so I got banned but I have an extra 3DS with CFW so I already can unban myself. The question is since all the games have the same titleid and it's been legitimately released in some countries is it safe to go online now or do I risk getting banned again?

Probably it is, but I'm going to wait till tomorrow just to be safe. Waiting another day won't hurt.

Ok my plan now is: -Try to get a European N3dsXL motherboard
-In the mean time check if I'm still banned
-If I'm still banned by January contact Nintendo to ask if I can get my NNID unlinked from my New3ds to relink it on my o3ds.
- Save as much data as possible from my N3dsXl to reinstall it on my o3ds.
-Make a backup of my current o3ds contants
- Go to the local console repair store and ask if they can install replacement motherboard.
-System tansfer from my o3ds to my New New3ds
-Never play online on unreleased games and pretend all that mess never happened...XD
