Well if someone just GAVE you a banned DS and you called Ninty expecting them to fix it don't be surprised when they tell you no. You aren't even claiming you bought it which is the only reason they would be inclined to help you with this sort of thing. You might as well just say you found it on the ground.........

this ban has happened before with other people playing games online early and it took 15 days for the ban to go away

Ok so after reading 168 pages of this forum I have a few questions.
1. I have a second 3DS I can use as my primary for now, it isnt a big deal but are there any risks of backing up my save from moon and injecting it on my actual game when I get it tonight? (Besides maybe changing the date or whatever)
2. Is there anyway of getting my NNID off my banned 3DS and putting it on the unbanned one?

If safety is your main concern, I wouldn't download it until the game is actually released for your region, tbh. :/
