Gaming Has anyone gotten banned from playing Pokemon Moon online?

true, but I'd need someone to take the picture with my name and date on it, just to be sure. But since the games aren't out yet..... not many people can do the pic for me.
 
on a side note, you think once the north american version of game is release will people in europe be able to play it safely? or should just wait for the european release?
 
Exactly. Banning people who own legit copies and have a legal right to back up said copies will not stand up in court - they will fold for anyone who can prove they own it, they are paying customers.

The only way to get a backup is by hacking their console on which you lose your rights to access the game licenses. Its a null point. This argument is the same as saying "I robbed a bank, but i keep my own money there so i'm innocent."

Obligated? You paid for a license which they clearly state is cancel-able if you hack/reverse engineer/modify their code and content. I hope Nintendo requires the hardware to be sent in to undo these bans or just leaves them standing.
Yeah obligated. It doesn't matter what TOS say - TOS can't be contrary to law. If someone pays you for a product or service you have to provide it. This is why this argument has already worked for someone in this thread. K thx.
 
Since day-one, i disabled 3DS Wifi and before that, i removed all connections saved. And for precaution, i'll go online only when someone dump a new retail cia.
Who used it online in a leaked copy, was very naive.

In a couple of days, when the games are out, I'm sure people will be able to share them.
I'm getting the game asap and will call Nintendo if the ban doesn't lift in 15 days knowing all the things I have to provide them.

Once again, it is not illegal to hack a nintento console it does not matter what their TOS say

Which is the grey area when it comes to backups and legality. It's legal to own and use, but the methods to obtain void warranty regardless. At the same time however the USA law clearly states in black and white "Video games in the form of computer programs embodied in physical or downloaded formats that have been lawfully acquired as complete games, when the copyright owner or its authorized representative has ceased to provide access to an external computer server necessary to facilitate an authentication process to enable local gameplay" which means they CAN take away your right to use their services but cannot legally bar you from playing purchased items electronically. Since that isn't the case here, it doesn't really matter but it's worth mentioning. Which is protected under the DMCA and WOULD hold up in court, so Nintendo really can't do more than turn off your internet. If you bought games and can't access them, but have them installed, the DMCA trumps a ToS any day of the week.
