I don't mind the tempban honestly if it's temp. I can understand some concerns if it switching to permanent.

What really hurts is the eshop ban. I do have games in there I have paid for and it sucks, Might consider calling them and seeing if Something can be resolved.

As far as I remember, in the topic on that site, the rom's dumper said it was safe to go online. Has there been a similar banwave before to act as precedent?

While we don't know if it's a permaban or not, and if this banwave is the only one that is happening, it is strongly advised not to go online until the release date. Backup your save and then inject it into the eShop, freeShop or cartridge version of the game.
