I have gotten banned for Playing Pokemon Moon.
I have a NNID Associated with my 3DS, I have never played Pokemon Sun or Moon online at all.
I have accessed the Friend Plaza, but it was always on local wireless and never online at all.
If I was prompted if I wanted to connect to the internet, I always declined.
Just having your 3DS's Wi-Fi on is enough.

Even if your system had it installed, if there's any trace of it left and your 3DS has connected to the internet, you are boned.
I contacted Nintendo and gave them the two error codes, and according to the specialist I was transferred to, it's a permanent ban.

I do not know if you can still get banned if you play when the game comes out, but they did state "any unauthorized game code" which would imply any .CIAs that are installed on your system that your account history on the e-Shop doesn't show.

The latest firmware must have some sort of snooper that cross-references every installed title ID on your system with your console's e-shop account, and if there's any mis-match, you are B&'d

This is a BAN WAVE, that means the bans are being sent out in waves. So if you are not B&'d now, you will most likely be B&'d in the near future. If you never get B&'d, go play your local lotto as you are lucky!

I hate to say it, but you most likely are.
It may not just be for Sun and Moon either, remember they said "any unauthorized game code", this would include any installed titles that either are unavailable in your region, are homebrew, romhacks, etc.

@DashAhead
This is my first ban, but I did contact Nintendo about this, and the rep on the phone said it's perminant and quoted the following:

"As a result of a number of Nintendo 3DS users using unauthorized versions of several games, and connecting to the official game servers in violation of our terms of service, these users’ Nintendo 3DS systems that stored the unauthorized game code have been banned from Nintendo’s online network effective immediately."

They state "several games" this isn't limited to Pokemon. This extends to any installed title that's not legally bought. This could also extend to Homebrew Launcher and any homebrew .CIA INCLUDING FBI

Unless they drastically changed I wouldn't assume homebrew/romhacks or foreign games would get you banned. I played through the entirety of yw3 tempura and never got banned for that. and every cfw user will be banned if stuff like Fbi and the likes become a flag. I think it was just this game honestly.

thanks for the paranoia. guess i should just throw my 3ds down a ditch since i'm getting banned anyways

I have an Nnid. i only battle ONCE, my friend force me to

Im hoping its only temporary
Oh weird normally those with NNIDs get both bans. Count yourself lucky I suppose? The ban you got is easily bypassable if you've got access to another console anyways and supposedly there's a way using NTR that hasn't been released. (unless that's been proven to be a ruse.)

It was. I don't like that people are now extending it to other games. Been playing YW2 online for a month or two now.

I honestly predict all bans will be permanent. That would be unprecedented, but this game's leak and news about the leak were also very unlike games preceding it. It is unlikely that they were able to detect anything other than the fact we were playing early, so any theories about them doing this for any reason other than Sun/Moon are probably incorrect.

It's not like it really matters, aside from Sun/Moon the last time I touched my o3ds was months ago kek. To those who are hoping for a better way to get around the ban: there probably will not be one. I also earn roughly $140 a day from my job, so this is no significant loss to me. Oh well, guess we'll see in December.

Can you not

The question now is if they plan on doing multiple waves of bans. The statement they released seemed pretty matter-of-fact that everyone has been banned despite those who went untouched. If not, I wonder what safeguarded those who by all accounts should have been affected?

Has anyone here been hit in this median period since the bans first happened?

@Quitchan Nintendo stated: unauthorized versions of several games, and Nintendo 3DS systems that stored the unauthorized game code have been banned from Nintendo’s online network effective immediately.

My old 3DS has FBI and I have played Mario Kart 7 online and have not been banned yet. I'll update after a day and see what happens. But I'm lead to believe that they added something in the new firmware update that can detect, and phone home your installed titles and cross-reference it with your e-shop account and if there's any mis-match you may get banned.

Honestly though, if you wanted to play online, you should have 2 3DS's anyway.
1 that's hacked for pirating and rom hacks/homebrew/etc.
1 that's legit, never hacked for playing online.

Microsoft does this, Sony does this, Steam and Origin do this. I'm shocked that everyone is so surprised that Nintendo is now doing this.
