I hate to say it, but you most likely are.
It may not just be for Sun and Moon either, remember they said "any unauthorized game code", this would include any installed titles that either are unavailable in your region, are homebrew, romhacks, etc.

@DashAhead
This is my first ban, but I did contact Nintendo about this, and the rep on the phone said it's perminant and quoted the following:

"As a result of a number of Nintendo 3DS users using unauthorized versions of several games, and connecting to the official game servers in violation of our terms of service, these users’ Nintendo 3DS systems that stored the unauthorized game code have been banned from Nintendo’s online network effective immediately."

They state "several games" this isn't limited to Pokemon. This extends to any installed title that's not legally bought. This could also extend to Homebrew Launcher and any homebrew .CIA INCLUDING FBI
Well if that were the case how come no one was banned BEFORE Sun and Moon when we've all been using .cias online while being on 11.2 anyway..... I had no problem whatsoever going online on anything installed. If Ninty really cared they would have implemented "unauthorized game code" checks automatically when you access the eShop to prevent it immediately, so I highly doubt that's the case. Unauthorized in the capacity of online play maybe, but unauthorized installs? I doubt it.

That quote is just word for word the quote handed to Kotaku/Polygon and says nothing about a permaban, and has the usual vague wording that PR teams use standard so as to not give away too much info to the people trying to squeeze out of punishment.

You try to make it sound like the bans don't have to do with specifically Sun/Moon, but they've been exclusively hitting people who played them. We know what's up even if their canned response hasn't confirmed it.

Because Pokemon Sun and Pokemon Moon are big games, and Nintendo may have decided to start banning people before the games came out to encourge people to buy the actual games and play them online without fear of hackers/cheaters/etc.

It could also be because everyone and their darn grandma were going "HURR DURR LOOK AT ME! I GOT POKEYMAN EARLY! BY THE WAY HERE'S SUM SPOILERZ!"

According to the Nintendo rep I spoke to, these bans are perma bans. Even the quote from Nintendo states that they are perma-bans.

Can you not

They have never banned people before for playing games early, and there have been LOTS of games leaked in the past. Any notion that this will be handled like previous games is therefore a rather large assumption, to be honest.

Was this ever confirmed??

There was never proof that he was banned in the first place. Take what he is posting as seriously as you might a leaker of a new game who does not post proof.
does anyone know for sure wether the bans are perm or not

Nope, but expect the worst so that you will at most be pleasantly surprised.

Yes because Nintendo is just going to straight out say "You're banned for good" and start an uproar, or say "It's only for now" if it's really not. They are vague on purpose. No sense in speculating whether it's temp or perma, we are banned either way. Either we can wait 15 days and check again, or buy a new DS, and get online with a cart. Sorry to those who are banned that actually paid for an eShop pre-load, you have my sympathy.

I just dont see how its not a temp ban. Cause they have to know people would just sell them off then and the people who buy them are screwed. Guess we'll find out in 15 days.

Luckily i pre ordered a physical copy and i have my friends 3ds for now.

Would Nintendo be able to detect on the 18th who has the lurantis cia installed? What should we do if we've been playing the game but haven't got online yet?

the way I'd assume it's perm is eshop being perm (eshop/NN anyways) and then allowing for normal online play for the most part. resulting in you having to get your system updates + dlc elsewhere basically.

Well what you said implied they would ban you on ANY game playing online with an unauthorized device (which IS the case with flashcards+public headers) Nintendo has NO WAY to tell if you're using a CIA or a catridge while you're online. All they can see if you're online and you shouldn't be, hence legit copies being banned too. That "unauthorized copy" thing is nonsense.

That's even dumber then outright banning everything. If you let us play online but block us from eshop your telling us your completely ok with us stealing games.

To be fair, it's nintendo we're dealing with here man. I wouldn't be surprised. I'm also just guessing based on what people on reddit said about the codes and how the one you get with eshop/nn is permaban code while the other is 15 days.

If you're playing a cartridge, dumped as a CIA it's essentially a cartridge and you would have NO history of purchase on the eShop anyway...... Regardless if you connected and got the "repair" screen.

Yea true. Nintendo is always dumb when it comes to stuff like this.

We'll just see in 15 days i guess. But honestly if its perm banned then idk how they gonna deal with the people calling in after everyone sells them off.

@QuitchanHonestly though, if you wanted to play online, you should have 2 3DS's anyway.
1 that's hacked for pirating and rom hacks/homebrew/etc.
1 that's legit, never hacked for playing online.

Microsoft does this, Sony does this, Steam and Origin do this. I'm shocked that everyone is so surprised that Nintendo is now doing this.
This^
I've bought a never hacked 2DS in 2015(My 3DS is very old and I wanted to change, plus I was scared to hack it without another console)and the hacked 3DS now banned because of Moon. but I don't care a lot for the ban - I can just buy an original copy(well, if they will still have stocks because I haven't pre-ordered it because I'm an idiot) and play on the 2DS, and if I want to modify the save I can use the cartdridge on the hacked console lmao.

Well if that were the case how come no one was banned BEFORE Sun and Moon when we've all been using .cias online while being on 11.2 anyway..... I think it's because Pokémon is their most..ehm, followed(?)franchise so I think they care about it, I mean, a big part of money comes from the Pokémon-franchise things sold, they have to care of at least that series, don't they?

A perma ban wave is pointless anyway. Like everyone else said, now we're just going to HAVE to pirate. I don't see how that's a deterent.

Look, all I know is what the Nintendo rep on the phone told me that they are perma-bans.

Right now all the people that have gotten B&'d are people that have PLAYED Pokemon Sun or Pokemon Moon.
I never connected to any of Sun or Moon's online feature at all and I was banned.

Just because they are only banning Sun and Moon players now, doesn't mean that they won't go after those that have installed .CIAs of Etrian Odyssey VI, Ever Oasis, or any other future game or past game.

It's rather simple to detect too, they just needed to add some way for Nintendo to see every title you have installed on your system then cross-refernce the title ID with the e-shop. They may have the ban bot set up to just ban those that have Sun and Moon installed via CIA right now.

Don't want to fear monger or anything, just stating; be careful.
If you want to be able to play online again, make a different NNID if you need to or want to, and go buy another new3DS or just a 2DS and never hack that one and use that one to play games online.
