No, you can download it from an european console, just setup your 3DS to AUS to get the australian eShop. But as I said, I'm playing with my japanese copy now and of course online too but I won't be affected by these bans.

I hope, this doesn't get to much into off topic, but what do you mean by setting up my 3ds to Australian? Simply use config.cia and change language?

I didn't know, that one can change the 3ds region for the eshop. I thought, the eshop gets the region information from my nnid?

It's some sort of special ban. Doesn't use NNID nor Serial number to ban. Most likely Mac Address.

Ok. But, that also means, that it could be dangerous to use the eshop copy, when I don't change my region. When I use it online on 18th with a 3DS with European region configured.

Yes, I tried, doesn't do anything in terms of being able to play games online, and I wasn't banned from the eshop in the first place so I'm not sure if it helps with that.

Note that the PID for me was 22, instead of 21 (Im on N3DS, USA)
