Yes, homebrew titles will show up on non-modified 3DS consoles through StreetPass, but no you are unlikely to get banned. NNID and other console-specific information isn't exchanged over StreetPass due to privacy, I think. So even if a Nintendo staff StreetPassed you, they wouldn't have any means of identifying your account.

Some of them have to be re-made with new recorded videos, and I just got AC: Unity so might as well throw that into the mix. All of the .cias combined should be done by the end of the day. I'll put them in a separate thread since it's not fully relevant to this one.

The video is prettier. But in terms of StreetPass-sending, it makes no difference.

Nope. Only things that install to the home menu. (Methinks it sends over the SMDH, hence the reason it works.)

If I'm right its only the homebrew apps that have an smdh, actual apps have it packed into the cia/tmd.

Well the icon.icn is an SMDH file. icon.icn is in the exefs of the CIA
