but it sucks caused i messed up iron fall on my second 3ds and i can't get homebrew back now i only have 1 homebrew 3ds

Nope, no luck either. Thanks for your suggestion anyway!

Well, I have a friend with a retail version of OoT, and I have the hax method in my 3DS XL through IronHax...
Guess with these two, I can install OoTHax into their retail OoT, then use on my 2DS to launch HBL and install ThemeHax.
Hey, can you try again, but this time put 107.211.140.165 on primary DNS and 107.211.140.166 on secondary DNS ? This shouldn't work but maybe the 3ds will automaticly fall back to no DNS if both fail, worth a try

Edit : changed the secondary DNS

something interesting I found. I found that if I have my internet connection disabled, I can fully explore and use the browser without needing to worry about the message, but once I turn on the internet and try to load a page, then it gives me the message. Odd. Maybe something can come from this?

Yeah, it only checks the update when you first connect out to a URL. If you can't get this workaround to work, then there's not really much else that we know of doing at the moment. System formats apparently won't work, going to recovery mode won't work, and deleting the browser's history and save data file won't work either.

Hey, does it pop up when the page loads or when you press a bookmark/URL to write ?

As far as I know, it's once you try to actually load a page. I'm going based on forum posts/hearsay here, I can't actually test any of this.

Now, nothing happens. The update message don't appear, but the browser tries to load the page indefinitely, so isn't possible to access BrowserHax this way...

Have you tried to load the page while Internet is off, and then once loading error apears you push the internet slider, press home menu and go back to browser ? Any luck
unfortunately, it still just keeps loading forever. You're on to something though

NINJA EDIT: After about 2 minutes the 3ds pops up a screen saying

"The Internet Broswer cannot be used at this time.

Please check your network environment or try again later"

When I press A, it brings me back to the system menu

BUT it keeps loading ? There is the loading animation ?

Yeah, the little squares on the top, right after the "Internet" banner, keeps moving.
But after some time, the following message appears on the bottom screen:

"The Internet browser cannot be used at that time.
Please check your network environment or try again later."

After that, pressing "A" returns you to the Home screen.

OK, once the message apears, close the browser, go to settings change the secondary DNS' last part from .166 to .065 and reboot the hand held then go to Internet as fast a possible.

Edit : once you started the browser don't touch anything for 5 seconds and see if it loads the page you were trying to load or not

Unfortunately, still no luck. Pops up with the usual "In order to use the internet browser... bla bla bla"

Slightly on/off topic, but I heard from somewhere that this message is being pushed out by Nintendo Network. Is there a way to block that and see if the message still pops up?

Still no luck, either. The update message returns...

Well then there is no luck for you, you'll have to wait a little bit for @smealum to block the relevant domains in his DNS.

According to #3dsdev, 107.211.140.165 is blocking the URL, but 065 is not. But it doesn't really matter once you've already gotten the update nag from the browser..

No explanation why this works for some yet, though?
