Since Cubic Ninja source code have a bug and was only released as a cart (here in US/EUR at least), even if Nintendo released a patch all you would do is simple uninstall the patch to restore the bug. And it seems Nintendo is not interested in patching games on the fly like Sony does (and I don't even know if 3DS has this capability), so they can't create a patch that fixes Cubic Ninja in the firmware either.I think it's because of one of the exploits used called gspwn, which is due to a design flaw in the GPU. It's not trivial to fix.

I would just like to point out that, on the Wii U, if you delete existing update data for games, you can't start them (even if you take the console offline). However, if there is new update data that hasn't been fully downloaded yet, you can still start the software. The Wii U is a home console though, so that might be why (not saying it won't be brought to the 3DS though).They can't simple screw customers like this. I mean, even Sony wouldn't disallow execution of games without patch, and Sony has a much stricter policy for hacks than Nintendo.
