Hacking Questions about DS firmware

I just have 2 questions about DS firmware because I wanted to get into portable gaming

1. If you buy a (new) New 3DS will it come with 9.0.0-20 installed or will it force me to install an update and make me install 9.9

2. If the answer to the above question is that it will force me to update, is there anyway to avoid it? I was thinking about updating from a game, but what games have 9.0.0-20 (Or the first version of a New 3DS)?

1. Highly unlikely to come with 9.0-9.2 unless you specifically hunt for one via serial numbers. No, it won't force you to update. If you leave the wifi on in standby mode it will download the update and ask you to do so, but it's always your choice to install it & you can get rid of it by booting into the update menu on start.

2. You can update from a game or from a .cia installer (DevMenu, BigBlueMenu, Sysupdater), using 3DNUS to download the update.

You can update with a ROM, by holding D-pad Up while booting GW mode update blocking will be disabled.
Puzzle_and_Dragons_Z_plus_Puzzle_and_Dragons_Super_Mario_Bros_Edition_USA_3DS-ABSTRAKT contains the 9.5.0U update.

Not good check ebay but not the ones listed as gateway compatible as they hike the prices up. I've brought many 3ds for use with cfw and gateway you just ask seller to check the firmware for you before buying. It's surprising how many people don't update there's or even connect to wifi on them.

Depending on the area, there are folks don't know the difference or don't care that the new model is slightly faster and has one game exclusive to it so they didn't buy it and it languishes on the shelf.
