Not necessarily. Let's say this post was real and DSTwo actually had a working cart. If they were utilizing a not-released exploit, it would function on the newest firmware if Nintendo had yet to patch it. Similar to how smealum was able to tell us his exploit worked on 9.2 within a few hours.
