ssspwn does not utilize a kernel exploit, it works in userland as far as I know.I'm suspecting that the kernel exploit is the same. I'm kind of wondering whether the 9.x firmware version of Gateway will have every feature.

Based on the logic that people like Myria are using, all Nintendo-related exploits are on Nintendo consoles, so there is a good chance that the Cubic Ninja exploit would work on the Wii U, as it plays Nintendo games too. Just put the 3DS game in the Wii U's SD Card slot.

Gateway may have been sitting upon a kernel/ARM9 exploit, but had no way to bootstrap it on 9.x. Smealum's exploit may have provided the necessary bootstrap, in the form of an exploitable game.
I can tell you on good authority that there's another hacker/developer RE'ing the distinct stages of Ninjhax and so far said hacker/developer found nothing that'd be capable of providing kernel-level access on 9.x firmwares.
