Hacking Using a online patched rom

I download a smash bros rom that was online patched and is a .3dz file. How safe will it be for me to use this and play online? I'm afraid of having my 3ds banned.

Nobody has been banned yet and there is no full proof way to play online other then having a retail cart and a 3ds on OFW

Edit: Please go into a little more detail about it being "patched" I think you mean it has a public header installed already

As the above said, it's probably a public header...
If you feel paranoid just grab a header from one of your own games and inject it in

IMOP no it's not, do you have a retail game of the same region you can use?

I also want to clarify that my opinion doesn't mean you will or will not get banned on a private or public header, I just think it decreases the risk of possible detection

I dont have any retail games just my gateway. thanks for your help!

Have you updated to the latest system update yet?

No i haven't updated yet. I wanted to ask you about it. Is it safe to update to system 9.x.x?

No; make sure you have a SSB rom from the same region as your 3ds and emunand installed. Boot into the gateway menu hold the d pad up and then click gateway mode. Once in emunand turn wifi off and boot SSB. It will prompt you for an update, once finished restart your 3ds, boot into gateway mode and you should now have emunand 8.1 and can now play SSB as long as you have a 4gb or higher big sd card in your 3ds

To boot into gateway mode do i use the blue gateway card or is that when I go to settings->nintendo ds prfofile?

Once you run the blue card it gives you the exploit for the gateway menu. After installing the exploit go to settings->nintendo ds prfofile and hold the L trigger to get into the gateway menu. After in the menu follow my steps above

I'm already on emunand 8.1. When i boot SSB it says i need to go to the eshop to download the update. But when i go to the eshop it says i need to do a system update.

8.1 is all you need, until gateway adds support for e-shop and the newest OFW you will have to enjoy offline play only
