There is nothing about "Nintendo 3DS" or "3DS" in the Trademarkia page. So the word "3DS" is probably aloud.

This is brilliant. Best one in the thread by the far, and how it goes along with the "launcher" theme is fantastic. The other front-runner is fine, and looks good, but the whole water-wave thing is exactly what we had with the Wii. This is something original for the 3DS, and as this will be the premier exploit for a long time I think originality would definitely be a good thing, as opposed to just living in the shadow of the Wii HBC.

I think if this had the jetstream animated it would be getting a lot more attention.
