At least you didn't send in your flashcard along with your 3DS. They would have done something if you did.

Your 3DS doesn't record that you play a flashcart. It has no way of knowing. it just sees you playing whatever game the flashcart uses, like Narnia and shit. Nintendo can't bust you for that.
Doesn't take a rocket scientist to figure that one out.
