Perhaps rather than using a ROM chip containing the game, the 3DS uses a Nintendo specified standard universal programmable cartridge with an EEPROM that is programmed through the access pins.
That would explain those one time scratches on your "new" game.

(Perhaps there will be no flashcart required for homebrew on the 3DS, just a programmer for the EEPROM with the proper interface for the access pins.)

Has anyone opened up and compared the circuitry of the DS, DSi, and the 3DS game cartridges?

If I ever get a spare 3DS game, I will asap. I don't want to take apart one I'm still using unless I know they can be put back together without tape.
