Gaming switch with mk8 without a code

Hi,
i bought a used second switch. There is preinstalled mk8 on it -> is it possible to transfer it into my nintendo account from my first switch and use it on the first switch ?

You'll need to get the original owner's Nintendo login details in order to transfer to another Switch.

pre-installed? did you buy it second hand because normally the game comes with a code or a cartridge and check if your banned or not because you may have been sold a banned console with mk8 on it still and i heard some games like fortnite and mk8 you can play online with a ban because they're not Nintendo servers

yes it was second hand, how do i check if i am banned, do i need to setup my nintendo network account on it and try to connect to eshop ?

yeah connect to eshop with a account logged in make sure you use a account you don't care about

yeah i heard a while ago apparently nintendo just rent the servers instead of hosting them unlike other Nintendo games

switch is not banned but i can't use the game so its all ok

It's probably just a game thumbnail which is "installed" when you the previous owner inserted a physical cartridge. It'll stay there unless you manually delete it by pressing "+" I think. I thought you meant a digital download, which is tied to a Nintendo account, and works as long as the account is still active on that Switch.
