Homebrew Specific Question - NNID

I'm sorry for making another thread about this, but it's just impossible to grasp specific information in the general thread. So the question is very simple:

I have 2 modded 3DS (Old with A9LH and New with B9S) and the two of them are unbanned right now.
They have something in common: No NNID was ever created on them (never, not even on a different version or before a wipe).

Have you been banned never attaching a NNID to your system?
