So I just discovered this:

"SSB4 Manual, page 7
About the Downloadable Version
If you have your save data on an SD card and try to overwrite it with save data you previously transferred to your computer, the Nintendo 3DS will not be able to read the save data. It is not possible to back up your save data this way, so please keep this in mind."

So this basically means it is pointless to backup the save file as it wont be readable. Have tried multiple times to copy my saved file across and just wont work.

If its in the manual then I suspect this is permanent and they will not release a patch to resolve this issue as it's an intended feature?

This sucks.

its intended to prevent people using old saves....same with pokemon so people can't just backup the save transfer all their pokemon and then just copy the old save back on......but as long as you haven't played the game since you made the backup it would still work.........basically think of it like a counter, every time you save it counts up and logs the number to the nand....if your saves counter doesn't match the log in the nand its considered corrupt,

Are you sure?

The exact wording in the manual makes it sound like it does not work.

"If You Own the
Downloadable Version
If you copy your software onto
a PC or other storage media,
please be aware that you will
not be able to use the
associated save data even if
you copy it back onto the SD
Card. It is not possible to back
up your save data."

Because I extracted the emunand and copied the save file at the same time. Injected the emunand into the second SD card and also copied across the save file and swapped out the SD card for the backup. Technically this counter wouldn't have changed. But the error message "Unable to use this save data as it is not the latest data. Would you like to create new save data?" still persists...

Edit: All files and folders on the sd card were copied over at the same time too

it should work fine, as long as you didn't boot the game between copying it to another SD there wouldn't really be any way of them knowing if it was copied off and back on....it would only be as and when the game loads that it unusable any more, if you booted the game up without it in place the counter would still go up for the game and the save would be unusable.....if your swapping SD cards you have to make sure its all done at the same time and you dont mess up and accidentally miss any files out.....also if you put the new SD on and let it create the 3ds folder and sub folders you have to delete them too before copying the backup on and before launching the game
