Gaming [Question] Loosing pre-Installed games?

Hello, I have recently bought a 2ds that belonged to someone else previously. I realized that Mario Kart 7 was pre-installed and I am wondering if I will lose it forever if I format the 2ds. I was able to add my own NNID and a friend told me that in that case the game had been migrated to my account and if I format the 2ds, I will be able to install it again using the eshop, but maybe the previous owner used his own account and linked the game already. What should I do?

If there was no NNID on the 2DS when you got it, you can link it to your NNID.

There wasn´t and I was able to log in with my own NNID but is there a possibility that the previous owner linked it to his account and then logged off?

You can't link another account to a 3ds/2ds without calling Nintendo.
