Hacking Pokesav and Pokebank

If i made a legal pokemon in pokesav and when i transfer it to pokebank (when it will be able in eshop) and over to my game, will i then get banned because of that pokemon?

Oh yes. You'll totally get banned for that. I know because I got an early release of the Pokebank and when I tried to do that very thing it told me the pokemon was banned.

In case you couldn't tell, I'm being sarcastic. Stop asking questions that no one could possibly know the answer to. Wait for the bank to come out so that people will actually be able to help you.
