I don't think it is a 3DS firmware.
You must have installed a downgraded System Settings menu, the one that let's you use th DS Profile hax.
If you do that on a 2DS and later format it you get this slider problem, but otherwise your system firmware is still a 2DS one.

so if i do the recovery menu update all hope for homebrew is gone correct?
 
I don't think so, but I don't follow the latest developments so much.
I believe ninjhax2 still works on latest firmware, but not sure.
Pretty much unless smealum *cough* yellows8 *cough* releases a new entrypoint.

You need exactly three things to run unsigned code on your console :
> A 3DS, 3DS XL or 2DS console with a firmware version between 9.0.0-X and 10.2.0-X. X can be any digit.
> An SD card compatible with your 3DS (the one it comes with will of course do).
> A copy of the game CUBIC NINJA, either from retail or eShop.
(retail is available in US, EU and JPN; eshop was JPN-only)

I think the last one is 10.2.0-28, but take into account that hack will let you use homebrew and emulators, but no backups, GBA cias, etc.

Unfortunately besides keeping on trying to update through the recovery menu your boned

The guides on this site do say not to flash 4.x system setting to 2ds and to use 6.x system setting since this is what happens sorry man

damn alright. gonna try and grab a new 2ds and return this one i suppose. thanks for the help everyone its much appreciated

Ya that's your best bet. Also if it were me I would get an old 3ds over a 2ds but it's entirely up to you, brand new on the box both of them should come with 9.2 or below.

Also next time make a nand backup BEFORE attempting ANYTHING. It's rule number one that way if anything happens you could flash it back with a nand mod

do they even still sell new old 3ds's lol. and i can only return a 2ds in a 2ds box, if i go in with it in a 3ds box theyre gonna be like "what" point is i bought this one second hand

Oh, they sell new old 3ds and if you bought yours second hand just hope your able to get a refund at all. good luck and when you get your new 2ds or 3ds wtv make sure to use 6.x mset(system settings) that way you don't have to worry about what happened again
