So i used SX OS on my old account on the old switch but got a new switch and would i be banned since i did play some XCI and NSP games? The account and system were not banned.

As long as you keep all the homebrew and custom firmware off the new hardware, the new hardware will be fine. However, the old Switch can still be banned.
