I believe game and firmware updates work even when you're banned, these services are seperated from the game authentication process, do some research.

For now! Nothing is preventing Nintendo from stopping them with a new software update. Get your facts straight.

It may or may not happen. My facts are fine. There is a big difference between current facts and future speculation
 
Yes, but that number is subject to change in the future. I also acknowledged that it's only a current incompatibility, so it's not necessarily forever. It's still a flaw.

And now it's just not a flaw anymore.

To the extent of my understanding, LayeredFS only works on 5.x. Is there a backup loader solution (other than buying TX) for those of us on 4.x or below? Not complaining, I can wait for it to come, but since the scene isn't organized as clearly as say, the old school PSP CFW scene, I can't seem to find the answer easily (and I did search!).

AFAIK there is a patch to make LayeredFS work on 4.x devices but for below I'm not quite sure.

Fun Fact: There were more people not banned due to using LayeredFS Online than those who were not banned due to using LayeredFS Offline.

Translation: Its safer to go online with LayeredFS than to remain offline :evil:

I believe the clearing of logs played a big role!? Those offline must have forgotten about it and the minute they showed online the crash reports were sent. But feel free to correct me.

Here's the problem. When I was looking retrospectively for the data, people just said they were banned using LayeredFS. Not much extra detail was given so I improvised the best I could. Of those who did report on clearing error logs, its a perfect split between those who did and didn't; 6 banned each. The rest are left to our imaginations.

To put it mathematically, let's assume only 20 out of 40 people were banned; 10 for LayeredFS Offline and 10 for LayeredFS Online. The 20 unbanned would be as follows: 15 for LayeredFS Online and 5 for LayeredFS Offline. While your chances of being banned were equal, the chances of not being banned were not. Thus, you have a higher rate of not being banned with LayeredFS Online over LayeredFS Offline.
