But Nintendo and other companies have all rights to make new firmware and the like that removes unofficial modifications. They are unofficial after all and Nintendo doesn't have to bend their updates just to comply with illegitimate modifications. They just can't prosecute people who have unofficial modifications provided there's not heavy evidence that it's used for piracy.
