nope!

I believe the themehax is installed in memory reserved for themes.
so there can be nothing occupying that space.

It is said that it's possible to change only the BGM, because of the way themehax works

Themehax only works with the default theme graphics because it corrupts how they're loaded.
Custom BGM is possible though. I'm pretty sure the tools to recompile with custom BGM are in yellows8's Github repository for Themehax.

From https://github.com/yellows8/3ds_homemenuhax#building
Build options:
  • "THEMEDATA_PATH={decompressed regular theme body_LZ filepath}" Build hax with the specified theme, instead of using the "default theme" one. When Home Menu starts the actual rendering however, the gfx for the theme doesn't display properly due to the hax. BGM works fine, therefore this should only used for BGM-only themes(where the themedata header is all-zero except for the version and BGM fields). Also note that compression during building takes a lotlonger with this.
