Thanks!

Nintendo said:Chapter II: Unauthorized Software, Services, or Devices or Unlicensed Accessories
Your Wii Console and the Wii Network Service are not designed for use with unauthorized software, services, or devices or non-licensed accessories, and you may not use any of these with your Wii Console or the Wii Network Service. Such use may be illegal, voids any warranty, and is a breach of this agreement. Such use may also lead to injury to you or others or cause performance issues or damage to your Wii Console or the Wii Network Service. We (and our licensees and distributors) are not responsible for damage or loss caused by unauthorized software, services or devices or non-licensed accessories. We may take steps to disable or delete any unauthorized software, services or device installed in your Wii Console, for example, by detecting and disabling them through the Wii Network Service and/or game software. If we detect unauthorized software, services, or devices, your access to the Wii Network Service may be disabled and/or the Wii Console or games may be unplayable.

That's console manufacturer's rules, not the law's... You just lose the warranty if you violate above described rules then again you need to sign / accept the EULA regarding wii beforehand... which you don't do when purchasing the wii but you do when you try to connect to wiiconnect24... Still in front of the court nintendo's EULA is not that important if it doesn't suit the laws of the very country the court held

ok don't want to be flamed nor considered as a troll but when i've read (a big word) the Wiiconnect24 EULA it says something like this: you're not allowed to emulate / pretending / use script to connect to Nintendo update servers. So for me even NUS Downloader ain't "legal".giantpune said:It is just by programs pretending to be a wii that we are able to get stuff from the server.
giantpune said:it is illegal to share IOSes. they are nintendo's/broadon's code. yes, they're on nintendo's update servers. but that does not mean that anybody is free to download it from there and pass it around. it is still their property. and they actually never meant for people to be able to download and view the contents of IOSes. It is just by programs pretending to be a wii that we are able to get stuff from the server.
When it would be illigal to have on your PC, then it's also illigal to have on your Wii. Try system menu tmd in your browser:

I didn't tell my firefox to pretend to be a Wii, but i can download from the server without any problems. As long as nintendo keeps the access to the server this way, nobody can tell that downloading from there for OWN use is illegal.
