A DSi flashcard IS legal under these conditions:
1). It CANNOT have firmware on it. Meaning that when you get it, you would have to flash it.
2). NO COMMERCIAL ROMS CAN BE LOADED ON IT WHEN IT IS SOLD.
3). YOU CANNOT ADVERTISE IT EXPLICITLY FOR PIRACY.
So...in short, if I have a "DSi Homebrew" flashcard that contains no commercial roms and no copy-protection circumventing firmware on it, it IS legal.
'Nuff said.
Using that logic, Action Replay DSi's should be banned in Germany. (Are they?)
