Even the JP based company aside, why would they bend to pressure from a group that's almost entirely pirates? Many people would likely think banning pirates and hackers is a good thing.

Yeah, realistically, the only people who care about people getting banned, are the people who are at risk of being banned for using unofficial software. No one else would care, when SciresM's post about the Switch antipiracy went up on Reddit, the gaming press was complimenting Nintendo on finally getting their shit together.

There's been a rise of shady behaviors like that lately to basically attack a company for defending their property (and legit players).
A certain MMO banned players a few months ago and was also attacked on the legal angle to circumvent these bans.

You know the rules when you attempt to go online with a hacked switch. Just don't if you don't want to face the consequences.

Though I would be delighted if this actually turns out to be working the way you intend it to be, I highly doubt they will kindly grant your request as in "You asked for it, here we will reverse your ban even though you heavily violated our Terms of Service" ;)

Edit: I never fully read their ToS (I mean who did and still remembers?) but I guess they are protecting their butt against anything like this. Or at least they will in the next ToS update :rofl:

ToS don't override law, in any case. Ever.
If ToS violate law, some or all of the ToS would likely be declared null and void.

Hardly against the law, regardless of country. Updates are provided as-is and are not legally mandatory, as is any digital purchase made.

But that's punishment that suits the crime. It's like if you go to a casino, win big and then get caught cheating. You get kicked off and aren't allowed to keep what you earned and don't get back what you spent

have you watched the movie "21" they used to beat the living shit out of you if caught cheating the house

Here's my point : Nintendo should not be allowed te prevent you from accessing games you bought no matter the reason. I insist, no matter why. However, they have the right to prevent me from playing online because it's a service, they don't owe me online play, however they owe me the right to play the game I bought, yes that's right, they owe me the right to play the game because like I said, I bought it. Steam for example doesn't prevent you from playing the game you bought, even if you're banned which is normal. It's my right you have to understand that. I gave you money now you give me the ability to play the game. It's a right you need to understand that.

That's just, like, your opinion, man. The law does not support you here (yet). Until someone sues Nintendo and we get some solid case law that says that they are either allowed or not allowed to do this, your feelings are just that, feelings.

You can update the console with cartridge updates, so ultimately you can play the game. Online has nothing to do in the matter.

Wrong, you bought a license to use that game (digital copy). By the way, Steam does ban accounts based on your offenses.

This applies to MMO games too (e.g. Overwatch); when you cheat, you got banned, and you lose all the stuff that you bought in-game.
Homo faber fortunae suae. If you behave bad and cheat/steal/hack/pirate, you're gonna pay for it (and btw whoever goes online with a pirated title is not a smartass).

the only way the can break the law on this point is to prevent physical updating as well as in carts, do they have the ability to do it probably, will they? no unless they can win/bribe EU courts
