I'm trying to update my son's 3DS. He bought it a few years ago from someone that had hacked the device. For years he was able to download games using FreeShop. I get why the application isn't working anymore so it doesn't need any extra explanation. I would love to know how I can update the 3DS to the latest (hacked) firmware and what application we need to use now to play back-ups. I prefer real back-ups (since I own a lot original 3DS games). Is there a guide on how to install the latest firmware and homebrew on a legacy hacked 3DS?

Well first and foremost, we need some more information to work with. Boot the system holding "Select" and tell us the version of Luma3DS that you are running. If it's anything below 7.1, then you will need to update to B9S and then to the latest version of Luma3DS.

Thanks the system is 7.0.2 so I'll look into the link. Any tips on how to prevent a brick?

dont use sleepmode, plug in AC charger.
once b9s -ed, use godmode9 to backup carts you own.

To update the bootloader+cfw I advice following that:

https://3ds.hacks.guide/

After that you can update to the most recent firmware using the software update from system settings.
Regarding piracy we can't help you, sorry.
