Misc Dumb slightly nooby question...

I picked up an used Mario/Luigi Dream Team (Dream Team Bros) 3DS XL and the previous user didn't format the system, which meant I still have the copy of Dream Team that came with the system. Would it be better to fully format and cfw and inject the game OR fully format and go legit? (I might side grade by system transferring my old 3DS onto Dream Team 3DS XL, but I would assume calling Nintendo would be helpful?)
