So what? He is the only one who will ever care about whether or not he legally obtained that file. Do you think lawyers will come after him if he sends an E-mail to Nintendo saying "Hey, I downloaded the FDS BIOS from the Internet even though I don't have a legal right to do so" ?

If you feel a burning need to conduct your every action according to a strict deontological framework at tremendous inconvenience to yourself then that is your choice, but that doesn't make it any less strange.
