I have found a unpatched console, the seller told me the software is up to date. Am I still good to go if on 8.1?

Yes, but I would ask the seller if he/she ever ran cfw on that console. If so, it could be potentially flagged for a ban.

They are not aware of CFW so it will be fine. My only concern is the condition really, apparently the screen has a protector on it, sadly one of the Joy Cons has some nasty scuffs. I am negotiating a price at the moment, no seen it in the flesh.
