Hacking Banned without playing online

All I want to do is set up Homebrew to transfer saves from my banned console to my legit one. I am not adding any games or saved files that are not from my legit purchased games.

Has anyone been banned for just doing this?

To answer your question, one user was banned for only using homebrew (a GBA emulator to be exact) as well as clearing error logs on 5.X, the latter of which might have contributed more to his ban than using homebrew. So long as you don't clear error logs, your chances of getting banned are minimal but not zero.
