AND ANOTHER DUMB QUESTION ABOUT WIIMMFI!!!

is it safe to use a rom downloaded from the internet *like mkw or accf or any multiplayer wii game* to use on wiimmfi? or will my wii get banned immediately, also another question *yes there IS another one* am i able to appeal a ban? as my wii is second owned and i am scared if i wasted money on an already softmodded used and banned console on wiimmfi. PHEW! that was alot to type but yeah

actually let me just put this into summary questions
(Q1) am i able to use a ROM from the internet to use on wiimmfi and not get banned?
(Q2) am i able to appeal a ban on wiimmfi?
(Q3) is it fine to use a second hand wii with wiimmfi, or if its already banned is it my fault and i cant do anything to prove that it WAS pre-owned?

it is safe to use 2nd console wiimfied as long not bricked console
but banned from wiimfi ? .. never heard that
