whilst i can see that this may come across less evil to nintendo, i doubt they will suddenly say "ohhhh well that worked out well lets remove our licensing fee's in future, people can just do whatever they like." its not going to change anything in that respect, all nintendo will see is "DAMN HACKERS HACKED THE 3DS THAT'S WHY THE WII U FAILED"
its nice that some hackers have some moral fiber and i commend them for trying to do what they think is right.

but really the only people who are being effected by this is people who would like to create/play with homebrew, piracy already exists, i can understand the hack for wii u not being released, the system still has its doors closed to piracy (of wii u games), releasing a hack for that would have a pretty bad effect on an already struggling system,

but with the 3ds its like closing the stable door after the horse has bolted....too little, too late, piracy has already happened

but as i have said all along, its up to the coder what they do, and don't do with their code, if anyone thinks they can do better nothing is stopping them......personally i know bugger all about coding and wouldn't know where to begin, but that's just my take on the situation :yaysp:
 
Problem is 3DS piracy isn't big enough. If Smea released all of his tools and allow kernel access someone might find a 7.1 exp. That will lead to mass piracy. Current piracy status is barely big enough for Nintendo to care. Their latest game still works with EmuNAND IIRC.

If someone found a 7.1 exploit, it would be great to homebrew. But that assumption is also a longshot. I doubt we'll see a further exploit before N reveals their next handheld. Even Smea says theres no reason to hold hope for a new expoint.

I think withholding kernel access based on such fears is really out of touch with things. Or anyone assuming we need shackles or any other cynical approach to homebrew. No one is going to be attracted to a niche homebrew ecosystem where one or two people put themselves in a position to be elite and control the system. At that point it has more to do with ego than preventing piracy.
 
Emus are legal. Pirating ROMs isn't.

We both know that 19 times out of 20, emulators will be used for pirating ROMs of the emulated machine.

Furthermore, DRM on Devolution has prevented a lot of legitimate uses, such as making it impractical to play on Wiis that can't read Gamecube games and not permitting translations or hacks.

(And to those hackers trying to "prevent piracy": because of you, pirates in China are millions of dollars richer selling what you wouldn't let people have and bricking systems in the process. Gateway would never have gotten off the ground if the exploits had been released to the public.)
 
Emulators are ok. It's piracy, but there is a difference. The emulated systems/games are not produced anymore and not available in shops at all. So it hurts no one except people trying to sell their originals.

I think of emulation more as preservation. Something more for the enthusiast that care about future generations being able to play those impossible to find carts.

I personally don't think it should be a factor on anyone's conscience. The preservation scene is among some of the most hard working people you'll ever get to know.
 
ahhh i going to buy a bunch of VC games, but if one kind of piracy is ok, thats great news :rofl2:

but seriously it does stink of double standards

i dont think the snes has got to the point just yet where the hardware/software is completely unobtainable so i dont think preservation really come into play, except in the case of one off copies of games(i.e prototypes) that if they where to fail would mean the game was completely lost forever
 
Can play the preservation card for piracy as well if you want.

Turtles in time, outrun online arcade and many others are delisted from XBLA due to rights issues.You want them now, get a jtag/rgh and pirate them.

So I guess that's ok as well then. Nice to know.

These piracy rules are getting really hard to follow. Going to need a list soon of what is ok piracy and what is not.

actual preservation involves preserving an original, not just making an unlimited amount of copies, thats just copying it doesn't preserve anything, its just a copy, unless the copy is to reduce usage on an original its not really applicable

Cracking and understanding the hardware is the first step to emulation. Just like how the Wii benefitted from the homebrew scene to give so much documentation to Dolphin I've heard.

Yeah, sure, people should try to preserve 3DS software. And eventually an emulator after the system isn't as relevant.. I only see it as a good thing and I don't see how it's hurting anyone.

Is BBC hurting financially from Dr. Who fans working hard to preserve and track down lost episodes that were thought to be destroyed?
 
I may hate digital-only and games-as-services, but I despise even further this... argument.
I currently dislike them enough to vote with my money, but when they themselves don't give you that option, I'm hardly sympathetic to them saying "but muh lost sales" if I acquire a copy by other means.

Never mind the fact that companies have no sane grounds to actually expect people to pay for end-product copies when the internet exists, it's like claiming that you own fire, and that people should pay you each time they kindle a fire for themselves or for someone else...

a new age.. Everytime progress changes things some people fail to adapt. PC gaming/Steam is flourishing, and that's the most open system, easiest to pirate for, but PC devs are growing faster and faster, so obviously some tired old fallacies about piracy are just not true.

piracy is the scapegoat of boardrooms, if a game is crap it wont sell and nobody plays it the easiest way to convince shareholders to keep their money in your company is to say that it failed due to piracy and the next game will feature even more advanced anti-piracy code to ensure "crappy game 2 the legend of poop" will definitely sell more copies because it cant be pirated as easy

ironic eh, back then nintendo was opposing video game emulation, later they adopted it.
I seem to recall that even their NES Classic series on the GBA used someone's own NES emulator developed for GBA flashcarts, without the emulator author's permission :o I remember hearing this back at acmlm years back.

Aha, i did not answer the question in the homebrew thread some hours ago for example, did i?

I just keep things secret, which would help pirating games. I don't support this in any way. I answered the question, and if someone asks things like that, he can't expect a serious answer.

I never claimed to know everything.
