Hacking 3DS Firmware 4.1-4.5

If I buy a 3DS and on the box, it says "(C) 2012 Nintendo" (basically, if it was made in 2012), will it be on firmware 4.1-4.5?

Also, some stores have empty 3DS boxes, and to get the 3DS, you have to bring the box to the cashier (I assume) and they will bring a 3DS for you to buy. If the empty box has the Copyright 2012 Nintendo and/or Copyright 2011 Nintendo, when you buy the actual 3DS from that store, will it be on those firmwares (4.1-4.5)?

If you get a new red flame or aqua blue 3ds is a given you will get 4.1-5 or even lower and yes as long as the box the 3ds is on sais (c) 2012 or (c) 2011 you will receive a 4.5 or lower 3ds.

If the store has an empty box just make sure the one they give you says 2012 on it. It's unlikely they update the boxes every year.

So if the store has the 2012 empty box, then I tell them I want to get a 3DS, the clerk will get a box with a 3DS inside, then I must check that box to see if it has the (C) 2012 Nintendo on it, then the 3DS will be on 4.5 or lower. Right?

right. What the empty box has doesn't really matter though.

in europe now red and blue 3ds with 2012 logo, they are most of the time 5.1 and up ....
