Nope you will only be banned for cheating online or for using a stolen credit card to buy stuff on the eshop or as @duwen said for using a modded game.

It shouldn't count no because it wouldn't be visible to anyone else you are playing for them to then report you. Unlike say playing Mario Kart 7 online but you have modded it so as your character is Sonic or something. Everyone would see your character as sonic.

Are you talking about Nintendo online account from Switch console?... Afaik, that type of account has nothing to see with NNID for 3DS, then you cannot associate it to a 3DS console (modded or not) after all, and you should and could create a new NNID account for your modded 3DS without problem
