first he stays in the clear because he does not do the software setup he only installs the chips
second i did not say who he is or specificaly where in texas hes at. i beleive if they were going to take him down they would have already but physical installations are not illegal we are allowed to do what ever we want to our consoles so long as it doesnt violate copyrights and simply installing a chip does not qualify as violating copyrights as he is not advocating piracy by installing them because homebrew by itself is not piracy as long as he does not setup atmospere on the sd card along with all the other apps required that do allow us to ride the high seas he is fine i know this because when nintendo did do a take down of sellers like this they could only take down the ones that setup the software the guy that did my first install also setup my software and he got shutdown from etsy the other guy that is in texas who also is on etsy did not get taken down because he did not setup the software he only installled the chip for those that go to him when they get back there switch they have to setup the software themselves for those of us that do use the chips to ride the high seas thats on us not the installer because we are using the chip for this purpose the seller does not choose how we make use of this chip us users do

i know im terrible at punctuation and i type like im dyslexic so my apologies for bad typing. i normaly try harder to remember punctuation but as i was originaly typing my nephew got in trouble with his dad and the yelling distracted me im adhd so it happens easy to me.

Make an emunand and downgrade it.

Don't do it on sysnand.

Jokes aside, I said use at your own risk, page also said the same.
I updated my switch by mistake because I didn't updated legends ZA, when I tried going online on sysnand, the prompt for update appeared and didn't let me go online, I thought the game was asking for the switch update and it was asking for the game update.
I need my switch working with Cfw for personal reasons. I know there is a risk using a non official (pre) release atmosphere. I was willing to accept the outcome.
Luckily for me the switch works fine, I don't have emmunand and probably won't make it. That's why I took the risk.

Again, if anyone wants to use it, remember there are risks.

Supposedly h menu doesn't work and probably some other stuff, but since I just needed to open atmosphere, it hasnt bothered me
