If I'm not mistaken, you can simply install it from the eShop.
It was "unlisted." You can still access the listing and download it, but you can't find it through conventional means. Someone would have to make a QR Code for people who have never used it, and people who deleted it can simply get it from their "Redownloadable Software" list.

I swear, I have seen it in the "most downloaded" section (or something like that...)

I had an account that had it before it was unlisted but I stupidly reset my 3DS, I can’t access it because it was a Nintendo network ID that wasn’t connected to a My Nintendo account, and I don’t have the confidence to reset my DS again.

To my knowledge, it doesn't need to be linked to a Nintendo Account in order for you to be able to log into it on your 3DS, and if you know the password, it's still possible to link to your Nintendo Account.
 
A lot of XLs had swapnote preinstalled, if you're lucky you might have the legit ticket for it buried within your ticket.db (I did!)

The app should be relatively trivial to find online on rom sites though, I'd wager.
