Don't connect the switch to internet while you are on atmosphere, that's the golden rule. I was using atmosphere since 2018 without getting a ban. I just forgot to cancel connection and started atmosphere once and I've been banned
I've literally been running atmosphere while online pretty much 24/7 for the past 2.5 years, lol.
Guessing you had pirated games? That would explain it.

I could play my original games online on ofw too. Just once i connected the switch to internet on atmosphere without doing anything and I got the ban

I am not sure why then, if you really have done anything illegal (like having NSPs installed on OFW -even without booting them-), I don't know what to say. Even if the risk exists, I didn't have any problems. Never. Perhaps, now I am banned, since it's been a couple of weeks since I last tried to connect online, but I won't probably be.

yes of course. But as long as I didn't connect my switch online on atmosphere (not online with backups just connected it) I could use it legit ( go online with original games on OFW).
I don't want to suggest anything to anyone, it's just my experience.

Sorry I tend to forget that someone use atmosphere for any purpose other than play backups

The question was "can", and yeah, if you are online, Nintendo can one day identify you and take you out.

If you want to run *any* mods online regardless, the question instead is "will they?" Recent bans seem to be connected to either NSPs, traces of XCIs, save editing, or cheating online. So overclocking, Retroarch and the like is probably safe from now, but of course things can change at any point.
will inject saved games also ban you?

In my experience, which has been for about two years (perhaps) using sysNand with Atmosphere (without any piracy -not even emulation-) just to update my sysNand via official means (the switch updater), I haven't had any issues.

I did try sys-clk once, but that's all. So, in my opinion, as long as you don't do anything like piracy or cheating in any way, as others said, you'll be safe.
But not burning fuses could they also ban you?

Dont inject save for online games with checksume such as Splatoon 2 or Smash, otherwise you should be fine as I've been injecting save everyday here and there without any issue. Pokemon is safe as well, doing since release date using PkHx.

Animal Crossing is safe as well :)

no, they dont ban you because of it. My ipatch switch running sysnand 4.1 offline/ emunand 1 online cfw+custom sysmodules / emunand 2 offline for backup.

Just dont pirate when online, 100% safe.

all keep playing for over a year

So you're just trying to check if the title you're releasing is legal? Let's say you could have backups installed with the Wifi turned off and free to play games online?

In these cases, hopefully Atmosphere will include a possibility to manage which games will be online and which will not.

I didn't pirate online. I Just connected my switch on atmosphere with nsps installed
Then your risk is very high to get banned. Dont do that way.

I dont pirate or install things to homemenu on sysnand, just homebrew and custom sysmodules. I install all my owned games (the cartridges) to emunand for switching game easily when travelling as I dont bring game cartridges with me and keep emunand offline (without any wifi connection).

Yeah to be clear, this is what "pirating" generally looks like. Connecting online with any NSPs even installed is dangerous, even homebrew forwarders.

Sorry my english sucks. I would say that I never play a backup online. I Just connected my switch by mistake while I was on atmosphere and i had nsp installed. As long as I played online on ofw with my legit games It was ok for years

Ban Risk according to Atmosphere devs:

Instant ban:
• Piracy of any sort
• Homebrew nsps
• Changing user icon through homebrew
• Sketchy eShop behavior

Not so instant ban, but still a ban:
• Modding online games, except in very niche circumstances
• Cheating in online games
• Clearing error logs after they've been uploaded to Nintendo (this may extend to using both emummc and sysmmc online, due to mismatched logs)

Not a ban, so far:
• Atmosphere itself
• Homebrew
• Custom themes
• Custom sysmodules (sys-ftpd-light, etc.)
• Mods/cheating in offline games
• Overclocking with sys-clk (just don't do it competitively, for all of our sakes)
• emummc

We just don't know enough yet:
• Screwing with PRODINFO, but NOT committing bannable offenses
• Using the experimental PRODINFO dummying included in Atmosphere 0.11.2 and later.

PS. Also been using atmos+clean emummc+online for a year now, no ban.

Are you sure about that ? A friend told me otherwise but if it's safe ... I would finally be able to play online

I'm pretty sure about it. been using cheat to get bells, tickets and items for a group of friends, cheating villagers (emuiibo) as well

So basically you play in emunand with cheats and all, and then you inject your save in sysnand with checkpoint or edizon to play online ?

this is why i got a second switch for modding, it never goes online and i dont care too much if it gets banned, but still use emunand although id love to be able to use sysnand instead if there was a way to block entirely nintnedo online stuff without getting it banned as its poor resell value

nope directly on sysnand. atmosphere, homebrew and custom sysmodules are 100% safe.

just dont cheat online competitive games such as Splatoon 2 and Smash.

Alright but at what point you inject your save ?
I'm planning to only play on my sysnand when I want to go online so I'll have to inject and backup my save each time I want to go from sysnand to emunand and vice versa, if I can use the same save on both then that's perfect but somebody gave me some warning about injecting being an instant ban but now I have some doubts. Do you edit your save with NHSE then inject in your sysnand ?
Sorry I'm asking a lot of things, but I've got a lot of conflicting pieces of advice so I'm a bit confused

Do whatever you want to to, just dont pirate and cheat online games with checksum such as Splatoon 2 or so.

NO BAN using save managers like checkpoint, Edizone and JKSV.

If there is a ban for such the reason, the author of Atmosphere will let us know, he's still good why people are afraid of? I've been using full set of all kinds of homebrew, custom sysmodules on sysnand online everyday.

Just be sure one knows which games have checksum and which don't.
